Individuals with Exceptional Ability in the Sciences, Arts or Business


Aliens or applicants who possess exceptional ability in the fields of sciences, arts, or business; and must have at least 10 years of experience in their respective field.

What Is Meant By Exceptional Ability?

It means such applicants must have proven work track or achievements that are higher or better than most in their field.

Who Qualifies?

Non-USA citizens who have a confirmed US job offer. This job offer needs to be in line with the applicant’s level of exceptional ability.

Who Files EB 2-B Visa?

The applicant’s US employer must file an Immigrant Petition for Alien Worker, Form I-140, on behalf of the applicant. It is an employment-based, second preference visa that must be accompanied by an approved individual labor certification from the Department of Labor on Form ETA-750.

What is The Biggest Benefit of EB 2-A Visa?

The EB 2-B visa allows an alien applicant to work for a longer time in the USA as long as he/she is employed with the US employer. He is basically qualified to immigrate to the USA.

Criteria In Detail

The United States Citizenship and Immigration Services (USCIS) has set seven criteria for the EB 2-B category of visas. The applicants need to meet at least 3 of these:  

  • Documents proving academic qualifications in your field of exceptional ability.

  • Documents from current or previous employers establishing that you have at least 10 years of experience working full time in your field.

  • A professional license, if applicable in your field of expertise or profession.

  • Proof of salary that’s commensurate with your level of exceptional ability and/or experience.

  • Membership of relevant professional associations in your field.

  • Documents of prizes and awards relevant to your field that signify or prove your contributions to your field.

  • Other evidence that substantially prove your exceptional ability.
